This includes acts such as graffiti, broken windows, or other deliberate harm. Coverage typically excludes damage caused by the insured, a tenant, or long-term vacancy of the property.
Vandalism refers to the intentional destruction or defacement of property, often driven by a general hostility toward the targeted structure and a sense of satisfaction derived by the perpetrator. Malicious mischief, on the other hand, involves property damage motivated by hatred, spite, or ill will.
For damage to qualify under the vandalism and malicious mischief peril, it must be deliberate and intentional. Accidental damage does not fall under this peril. Simply put, damage to property does not automatically constitute vandalism or malicious mischief unless intentionality can be established.
This peril does not cover losses to vacant properties if the property has been vacant for a specified period, typically 60 consecutive days before the loss. However, buildings under construction are not considered vacant.
Additionally, this peril excludes losses caused by theft or burglary, as those are covered under separate perils.
