Coverage E - Personal Liability

Personal Liability coverage is for bodily injury or property damage liability related to an occurrence by a policyholder.

Coverage E Qualification

In order for a claim under liability to be paid, the policyholder must be considered negligent in causing the bodily injury or property damage to a third party. Homeowner negligence would include things like:
- Loose railings or stairs that may cause someone to fall
- The homeowner’s dog bit the mailman
- A guest slipping and falling and breaking a leg on a severely cracked driveway


Coverage Requirements

Without negligence, there is no liability, and without liability, Personal Liability protection does not apply. To establish negligence, the following four elements must be proven:

  1. A legal duty owed by the insured to another party.
  2. A breach of that legal duty by the insured.
  3. An injury (including death) suffered by the claimant.
  4. Evidence that the insured's breach of duty directly caused the injury.
